Property Law Update in Turkey: Title Deed Values, Digital Procedures and Rental Rules

The Turkish real estate market is becoming more transparent through increased use of digital records, data sharing and risk-based review processes. For property owners, buyers, landlords and tenants, it is important to follow current rules carefully and to distinguish between laws already in force and proposals still under discussion.

1. Greater Focus on Declaring the True Sale Price in Title Deed Transactions

The declaration of the true sale price during title deed transfers has become an increasingly important issue.

Declaring a sale price below the actual amount agreed by the buyer and seller may create legal and financial risks. Where a discrepancy is identified, the title deed fee difference, applicable penalties and late-payment charges may arise under the relevant legislation.

For this reason, property buyers and sellers should ensure that the sale price declared in the official deed accurately reflects the real transaction value. Bank transfer records, payment receipts, sales agreements and other supporting documents should be retained carefully.

In transactions related to Turkish citizenship by property investment, the official sale price, the value shown in payment documents and the valuation or amount determination documents are assessed together. The General Directorate of Land Registry and Cadastre states that all relevant value types must meet the required threshold. TKGM official guidance

2. Digitalisation of Title Deed and Property Procedures

Digitalisation continues to shape title deed and property procedures in Turkey.

Electronic application systems, online access to municipal property-value information in certain locations, digital document sharing and data-based controls are improving transparency and traceability. In specific processes, particularly citizenship-related property acquisitions, valuation reports or amount determination documents are also part of the official procedure.

However, the requirements may differ according to the type of transaction, the buyer’s status and the purpose of the acquisition. Before starting a transaction, it is advisable to confirm the current document requirements with the relevant title deed office and qualified professionals.

3. Rental Increases and Five-Year Lease Agreements

For residential and roofed workplace leases, Article 344 of the Turkish Code of Obligations remains the main legal reference for rent increases.

As a general rule, an agreement on the rent applicable to a renewed rental period is valid provided that it does not exceed the change in the twelve-month average Consumer Price Index CPI of the previous rental year. This rule also applies to lease agreements longer than one year.

For lease agreements that have completed five years, the determination of rent becomes particularly important. In rent determination cases, the court may consider the CPI rate, the condition of the property and comparable rental values in the area. Therefore, current market data, comparable rental advertisements and the wording of the lease agreement should be reviewed carefully.

The rules may vary according to the particular lease relationship. Article 344 of the Turkish Code of Obligations should be read together with the full agreement and the circumstances of the case. Turkish Code of Obligations No. 6098

4. Draft Legislative Discussions Affecting the Real Estate Sector

Several topics affecting the real estate sector continue to be discussed in public policy and possible legislative work. These include:

  • Strengthening the declaration of actual values in title deed transactions

  • More effective monitoring of rental income

  • Administrative arrangements affecting real estate businesses

  • Increased use of digital data in property-related procedures

It is important to remember that a proposal, draft text or public discussion does not become binding law until it is officially enacted and published in the Official Gazette.

Property owners, investors, landlords, tenants and real estate businesses should therefore avoid making decisions based solely on preliminary announcements or social-media reports.

Practical Recommendations for Property Owners and Investors

  • Declare the actual sale price in title deed transactions.

  • Keep bank transfers, receipts, contracts and payment records.

  • Make rental payments through bank or postal channels and retain supporting documents.

  • Review the lease agreement before applying a rent increase.

  • Obtain legal, tax and financial advice for complex transactions.

  • Follow official announcements published by the relevant public authorities.
